LEARNING SESSION: The End of Non-Disclosure Agreements? Why NDAs are Bad for Your Business
Once an unchallenged default in settlement agreements and hiring contracts, non-disclosure agreements (NDAs) are increasingly recognized as unfair, unnecessary, and often legally unenforceable.
Large corporations such as Google and Salesforce no longer use NDAs. Growing numbers of smaller businesses are taking the decision to promote transparency and attention to workplace complaints, in order to prevent issues ballooning into large-scale, reputation-harming conflicts.
Dr. Julie Macfarlane, Co-Founder of the Can’t Buy My Silence campaign, will discuss the work of the campaign and the changing national and international business context for NDAs, and alternative ways to protect victim privacy.
This session is aimed at anyone making decisions about how their business protects employees from workplace discrimination or harassment, and how to ensure NDA-free, fair and transparent, workplace conflict systems.
About the Presenter:
Dr. Julie Macfarlane
Julie is Emerita Distinguished University Professor of Law and a Member of the Order of Canada for her advocacy on access to justice and on behalf of survivors of sexual violence. Julie is Co-Founder with Zelda Perkins of Can’t Buy My Silence, campaigning to make the misuse of non-disclosure agreements illegal.
